Customer means the individual or business purchasing services from Carpet Cleaners W1T.
Services means any carpet, rug, upholstery, curtain, mattress or related cleaning services provided by Carpet Cleaners W1T, including stain removal and stain protection where applicable.
Premises means the property, whether residential or commercial, at which the Services are to be carried out.
Booking means a confirmed appointment for the provision of Services by Carpet Cleaners W1T.
Technician means any employee, contractor or representative engaged by Carpet Cleaners W1T to perform the Services.
2. Scope of Services
Carpet Cleaners W1T provides professional carpet and soft furnishing cleaning services within its operating area. The specific scope of work for each Booking will be agreed in advance based on the information provided by the Customer regarding the Premises and items to be cleaned.
All Services are subject to availability and to the condition and accessibility of the items and areas to be cleaned. We reserve the right to decline or modify a Booking if, in the reasonable opinion of our Technician, the requested work cannot be carried out safely, lawfully or to a satisfactory standard.
3. Booking Process
3.1 Bookings may be requested by telephone or through our online enquiry channels where available. A Booking is only confirmed when we have provided explicit confirmation and you have accepted the proposed date, time and price estimate.
3.2 At the time of Booking, you must provide accurate information regarding:
a. The type and size of the areas or items to be cleaned
b. The general condition of the carpets, rugs, or upholstery and any known stains or damage
c. Access arrangements to the Premises, including parking availability and any restrictions
d. Any relevant health and safety considerations, such as the presence of pets, allergies or hazardous materials.
3.3 The Customer is responsible for ensuring that a person aged 18 or over is present at the Premises for the duration of the appointment, unless otherwise agreed in advance.
3.4 Any time or date given for the performance of Services is an estimate only. We will use reasonable endeavours to attend on time, but we accept no liability for minor delays caused by traffic, weather or other circumstances beyond our reasonable control.
4. Prices and Quotations
4.1 Prices for Services will be provided in advance based on the information you give at the time of Booking. Unless stated otherwise, prices are quoted in pounds sterling and include applicable taxes.
4.2 The price quoted may be subject to adjustment if the information supplied by the Customer is incomplete or inaccurate, or if the Technician finds that the work required is substantially different from that originally described. In such cases we will discuss any change to the price with you before proceeding.
4.3 Any promotional offers or discounts are subject to specific terms and may be withdrawn or amended at any time without notice. Offers cannot ordinarily be combined unless expressly stated.
5. Customer Obligations
5.1 The Customer must ensure that:
a. The Premises are accessible at the agreed time, with clear and safe entry for the Technician and equipment.
b. Adequate electricity and water supplies are available for the duration of the appointment.
c. Fragile, breakable or valuable items are removed from the working areas or clearly pointed out to the Technician before work begins.
d. Any pets or young children are kept away from the work areas during and immediately after cleaning until carpets, rugs and fabrics are sufficiently dry and safe to walk on.
5.2 The Customer must not request or permit the Technician to undertake any work that is unsafe, illegal or beyond the agreed scope of the Services.
6. Payments
6.1 Unless agreed otherwise in writing prior to the Booking, payment is due immediately upon completion of the Services.
6.2 We accept the forms of payment notified to you at the time of Booking. Where card payments are accepted, we reserve the right to take a pre-authorisation before work commences.
6.3 For business customers and account holders, alternative payment terms may be agreed in writing. In such cases, payment must be made by the due date stated on the invoice.
6.4 If payment is not received by the due date, Carpet Cleaners W1T may charge interest on the overdue amount at the applicable statutory rate, together with any reasonable costs incurred in recovering the outstanding sum, including debt collection fees and legal expenses.
7. Cancellations and Rescheduling
7.1 The Customer may cancel or reschedule a Booking by giving notice to Carpet Cleaners W1T.
7.2 If you cancel or reschedule more than 48 hours before the scheduled start time, no cancellation charge will usually apply.
7.3 If you cancel or reschedule with less than 48 hours notice, we reserve the right to charge a cancellation fee up to a reasonable proportion of the agreed price to cover allocated time and costs.
7.4 If the Technician is unable to gain access to the Premises at the agreed time, or if the appointment cannot proceed due to the Customer failing to meet the obligations set out in these Terms and Conditions, this may be treated as a late cancellation and a fee may be charged.
7.5 Carpet Cleaners W1T may cancel or reschedule a Booking at any time due to circumstances beyond our control, including but not limited to illness, adverse weather, equipment failure or access issues. In such cases, we will offer an alternative appointment. We will not be liable for any indirect loss or inconvenience arising from such cancellations.
8. Service Standards and Limitations
8.1 Our Technicians will exercise reasonable skill and care in providing the Services, using appropriate cleaning methods and products suited to the materials and condition of the items being treated.
8.2 While we will use our best efforts to remove stains and marks, we cannot guarantee that all stains will be removed completely. Stain removal success depends on the nature of the stain, how long it has been present, previous attempts at cleaning, and the type of material.
8.3 Some materials and backing types may be prone to shrinkage, colour bleeding or changes in texture when cleaned. We will endeavour to identify and discuss such risks with you in advance, but we cannot be held responsible for pre-existing damage or inherent weaknesses in fabrics, carpets or underlay.
8.4 The Customer is advised to allow sufficient drying time before walking on cleaned surfaces or replacing furniture. We will provide general guidance, but actual drying times vary according to ventilation, temperature, humidity and fabric type.
9. Damage and Liability
9.1 Carpet Cleaners W1T will maintain appropriate insurance cover for public liability and, where required, employer liability. Details of insurance can be provided on request.
9.2 If accidental damage occurs as a direct result of our negligence, you must notify us as soon as reasonably practicable and in any event within 48 hours of completion of the Services. We may request photographic evidence and an opportunity to inspect the damage in person.
9.3 Our liability for any loss or damage arising out of or in connection with the Services shall, to the fullest extent permitted by law, be limited to the lesser of the cost of repairing the damage or the price paid for the specific Service which gave rise to the claim.
9.4 We shall not be liable for:
a. Wear, discolouration or damage that already existed or was reasonably foreseeable due to the age, condition or type of material.
b. Any loss or damage arising from inaccurate, incomplete or misleading information supplied by the Customer.
c. Any indirect, consequential or economic loss, including but not limited to loss of profit, loss of business or loss of opportunity.
9.5 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by negligence, fraud, or any other liability which cannot lawfully be limited or excluded.
10. Waste, Disposal and Environmental Regulations
10.1 Carpet Cleaners W1T will comply with applicable UK regulations relating to the storage, handling and disposal of waste water, cleaning residues and any other waste materials generated in the course of providing the Services.
10.2 Where practical, waste water will be discharged into appropriate drainage at the Premises, such as designated waste pipes or external drains, in accordance with local requirements. We will not discharge waste into surface water drains or other prohibited systems.
10.3 If, in the course of the Services, hazardous materials or waste are encountered, including but not limited to asbestos, contaminated flooring or bodily fluids beyond the scope of normal cleaning, we reserve the right to suspend work and advise the Customer to seek specialist assistance. Additional charges may apply where specialist disposal is required.
10.4 The Customer agrees not to request or permit any form of waste disposal that would breach environmental regulations or the terms of any local water or waste authority.
11. Health and Safety
11.1 We operate in accordance with relevant health and safety legislation and aim to ensure that all work is carried out safely for Customers, Technicians and others on the Premises.
11.2 Certain cleaning products and processes may require temporarily restricted access to specific areas, particularly for children, pregnant persons, elderly persons or pets. The Customer agrees to comply with any reasonable safety instructions provided by the Technician.
11.3 The Customer must inform the Technician of any known allergies or sensitivities that may be relevant to the use of detergents, deodorisers or stain treatments. Alternative products may be used where suitable options are available.
12. Complaints and Service Issues
12.1 If you are dissatisfied with any aspect of the Services, you should notify Carpet Cleaners W1T as soon as possible and, in any event, within 48 hours after completion of the work.
12.2 We may request details of the issue, including photographs where appropriate, and may arrange for a Technician to return to inspect the work. Where a complaint is justified, we will seek to remedy the situation, which may include re-cleaning affected areas or a partial refund, at our discretion and subject to the circumstances.
12.3 Failure to allow us a reasonable opportunity to address any concerns may affect any remedy or refund that might otherwise be available.
13. Force Majeure
13.1 Carpet Cleaners W1T shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events or circumstances reasonably beyond its control. These may include, without limitation, extreme weather, transport disruptions, strikes, pandemics, accidents, fire, flooding or acts of government.
14. Privacy and Data Protection
14.1 We will handle personal information in accordance with applicable UK data protection laws. Information collected during enquiries and Bookings will be used to arrange and provide the Services, manage payments and, where consent is given, to inform you of relevant offers.
14.2 We will not sell your personal data to third parties. Limited information may be shared with trusted partners and service providers solely as necessary to deliver the Services and process payments, under appropriate safeguards.
15. Amendments to Terms and Conditions
15.1 Carpet Cleaners W1T reserves the right to update or amend these Terms and Conditions from time to time. Any changes will take effect when posted on our legal information pages or otherwise communicated to you.
15.2 The version of the Terms and Conditions in force at the time of your Booking will apply to that Booking, unless a change is required by law or regulatory authority.
16. Governing Law and Jurisdiction
16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services, without prejudice to any mandatory rights you may have as a consumer to bring proceedings in your local jurisdiction within the United Kingdom.
17. General Provisions
17.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision shall be deemed deleted and the remaining provisions shall remain in full force and effect.
17.2 No failure or delay by Carpet Cleaners W1T in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that right or remedy or prevent its future exercise.
17.3 These Terms and Conditions constitute the entire agreement between Carpet Cleaners W1T and the Customer relating to the Services and supersede any prior understandings, agreements or representations, whether oral or written, regarding their subject matter.
